Article 1 : Application of the present general terms of sales

Placing an order to VINATIS involves the buyer to completely subscribe to the general terms of sales, with the exception of all other documents published by the seller such as leaflets, catalogues, which give only an indicative value. The buyer books the order in clicking on "confirm my order". Unless particular and agreed in writting, stipulation between the parts, the orders are subject by rights of the present general terms of sales in addition whatever the clause included in the buyer's documents.

The present general terms of sales are at the buyer's disposal on the homepage of VINATIS' website.

Article 2 : Terms of order and payment

Orders become definitive as soon as they are totally paid by the buyer. However, VINATIS reserves the right to refuse any order from anyone we suspect of making purchases by fraudulant means. The buyer may pay by credit card, by cheque (made payable to VINATIS) and by swift bank transfer. VINATIS mails out an invoice and sends it to the invoicing address. Credit card payments are secured by on-line payment system with SSL (Secure payment system) standard. VINATIS retains ownership of the products ordered until reception of the full payment for the products, in accordance with the law n°80 336 from the 1st may 1980, relating to the property reserve. However, risks on the products will pass to the buyer upon delivery.

All our offers are of course within the limit of available stock without engagement and except as sales in the meantime.

If a reference is not available, we may offer a replacement product of equal or increased value to you. You have the right to accept or refuse this replacement product. If you refuse, you may claim a refund of the amount paid.

Article 3 : Prices

Prices are given in Euro, the prices given in another currency are only as a rough guide. All prices are inclusive of VAT and costs of delivery. The set price is given in the order confirmation, inclusive of tax (applicable VAT, customs dues and all other applicable taxes). This price include the product, handling, packaging, storage and transport costs.

Somes references will be subject to a minimum order. This particular term is clearly defined for all concerned references on the web site.

All special offers (discount and purchase coupons, partners discounts...) are limited to 1 person per home and per offer. VINATIS expressly reserves the right to refuse any order which doesn't meet the requirements as far as this standard is concerned. 

Article 4 : Delivery and receipt

All orders are subject to acceptance by VINATIS who will proceed to the delivery after payment of the order. Orders are delivered to the address mentionned in the field "delivery address". The buyer is responsible for the given information : in case of mistake in the delivery address, the seller is not responsible for the impossibility to deliver the order.
 

VINATIS will make every effort to deliver the orders in the fastest delays. Delivery comes into effect when the order is delivered to the given person or if out, from the disposal notice. The buyer is not allowed to cancel and refuse the order or asks for damages in case of possible delay.

Delivery delays vary according to the delivery place, the payment receipt or the bank authorisation (online payment by credit card). VINATIS undertakes to deliver the orders within 4 working days in Metropolitan France and within 8 working days in the European delivered countries (Germany, Belgium, Spain, Italy, Luxembourg, Austria, United Kingdom, the Nederlands).

The seller is not required to deliver in case of major force : war, riot, fire, strike, accidents and impossibility of beeing supplied.

Transported goods are under the responsability of the addressee who must control the parcel and if needed, display all legal reserves : on the delivery note supplied by the carrier or in the presence of the delivery man, by calling the Customer Service of the carrier.

All displayed prices are carriage paid for delivery in European countries (Germany, Belgium, Spain, Italy, Luxembourg, Austria, United Kingdom, the Nederlands).

Article 5 : Returned goods

In accordance with the article L.121-16 of the Consumption Code, the Buyer has 14 days with effect from the delivery of the order, to send it back to the seller, according to the Buyer's choice, for change or refund, in good state and with the original packaging and invoice. VINATIS will refund the Buyer in deduction of the missing and opened bottles.

The customer is responsible of the return costs.

All returns are subject to acceptance by VINATIS : the customer must inform the VINATIS Customer Service in writing (e-mail : see under 'Contact us' on the website, fax, registered mail) and VINATIS will choose the carrier.

Moreover, if the customer notes a mistake from VINATIS (for example : the delivered article does not comply with the ordered article), VINATIS undertakes to refund the customer on all expenses : the price of the product increased with return costs, shipment costs as far as the returned product is in good state.

Article 6 : Applicable legislation

Those present general conditions and terms of sales are governed by French law. If a dispute arises, VINATIS and the customer will do their best to find an agreement. Failing this agreement, the contract will come within the juridiction of the Trade court of Chambéry. Whatever delivery address and the way of payment agreed, and with the possibility by VINATIS to reffer the contract to another court of competent juridiction.

Article 7 : Legal information

Pursuant to ruling n° 59-107 of January 7th 1959, by placing an order through our web site you warrant that : you are legally capable of entering into binding contracts and you are at least 16 years old.

Alcohol abuse can seriouly damage the health. Drink and enjoy with moderation.

Personal Data and rectification rights : in accordance with article 27 of Law n° 78-17 from January 6th 1978, personal data are used to provide the customer with information and services that he may request. All these information (name, address) are exclusively used by VINATIS. VINATIS is notified to the CNIL. The customer has the right of access and rectification of the data recorded.

VINATIS does not sell or rent customers personal data and information.
